Trade Conditions

FOCUS data is strictly confidential. The customer is only allowed to use the data for internal information during the contract period. The customer merely acquires rights of use, that means that the client may neither pass on FOCUS data in original or processed form to third parties neither free of charge nor for remuneration, in written or verbal exchange or by allowing inspection. The company defined as end user in this contract is excepted.
Careful data acquisition and control allow for detailed reporting. In case that misunderstandings, which are not negligible, occur belatedly FOCUS is covenanted to make available corrected data. Neither torts including consequential loss nor claim for minimising loss can result from that on the receiver's part.
FOCUS reports are services and are payable after billing without deduction of allowance and discount. Invoice receipt after more than 2 calendar weeks after due date entitle FOCUS to charge default interest - amounting to 12% p. a. from due date according to the chamber of commerce. Customer wishes concerning specific billing such as billing addresses differing from the customer can be accounted for if they were communicated at the acceptance of bid. A belated change of bills cannot be arranged.
The price lists, confirmations of order and quotations contain net prices which are valid to the expiration of the calendar year in which the quotation or the subscription was made. FOCUS is authorised to deal with price alignments during the period of validity of subscriptions every 1st January. The extent of the price alignment is based on the development of costs for service provision with the same contents of reports. Postal charges and mailing expenses are settled separately.
For expedited services which due to their workscope cannot be carried out within reasonable time during regular office hours FOCUS reserves the right to make special arrangements with the clients.
